BaghdadiLaw’s experience in cheque matters in the UAE

BaghdadiLaw brings nearly seven decades of legal practice, since its founding in 1957, to cheque matters, with a firm understanding of the cheque’s role in the transaction, payment claims and defences involving signature and discharge. A returned UAE cheque may raise questions about the bank's stated reason, payments already made and the identity of the liable party. Those facts help distinguish an available execution route from a disputed debt requiring a different response.

UAE Commercial Transactions Law 50/2022 Article 667 treats a cheque carrying the bank's statement of non-payment for insufficient or absent funds as an executive document. Other return reasons and any dispute about the balance require separate assessment. Keep the cheque and bank return record with the underlying account and payments. The return reason and outstanding balance need separate review before a remedy is selected.

We agree the work your matter needs: For the specified insufficient-funds bank statement, assess the Article 667 execution route. For another return reason or a disputed holder, resolve the relevant defect first. A documented settlement can address cash-flow difficulty once the true balance is reconciled. The deliverable is agreed for your file: A cheque-and-balance review explaining the bank evidence, outstanding sum and matters affecting execution eligibility or a substantive objection.

Common questions

Before requesting advice on cheque in the UAE

What should be checked after a cheque is returned unpaid?

Preserve the cheque, bank response, presentation dates and transaction records. Reconcile any payment and identify the drawer and relevant jurisdiction. The reason for return matters; different reasons should not be treated as one automatic remedy.

Does every returned cheque meet Article 667 automatically?

No. The specified provision concerns a cheque bearing the bank's statement of non-payment for insufficient or absent funds. A different return reason, disputed holder or payment already made requires its own assessment before execution.

Can collection ignore a later bank transfer?

No. Identify what obligation the transfer paid and its allocation. If it discharged all or part of the cheque debt, the recovery balance must reflect it; keep bank evidence so the same amount is not demanded twice.
