BaghdadiLaw

BaghdadiLaw’s experience in enforcement of cheques and promissory notes in Saudi Arabia

BaghdadiLaw brings nearly seven decades of legal practice, since its founding in 1957, to enforcement of cheques and promissory notes, with detailed knowledge of each instrument’s requirements, the underlying debt and potential objections. A cheque and a promissory note are different Saudi commercial instruments, even when issued for the same business debt. Enforcement review should identify the instrument, signature, maturity and remaining obligation. The underlying contract may explain a defence but should not replace examination of the instrument itself.

The Enforcement Law recognises qualifying commercial instruments. Their formal requirements and defences must be considered under the relevant commercial-paper rules, while a dispute about the underlying transaction may require a distinct analysis. As of 19 September 2026, the replacement Enforcement Law published on 1 May 2026 is not yet effective: Article 65 provides commencement 180 days after publication. Check instrument type, filing date and transitional rules; do not impose the replacement text’s platform-registration requirement on a promissory note as though it were already in force. Compare the instrument holder, named beneficiary and any transfer history. Possessing a copy does not by itself explain entitlement to collect the instrument.

We agree the work your matter needs: Seek payment, assess execution eligibility or prepare a specific objection concerning payment, authenticity or the asserted obligation. The deliverable is agreed for your file: An instrument-form and balance review, payment reconciliation and assessment of the appropriate execution or objection route.

Common questions

Before requesting advice on enforcement of cheques and promissory notes in Saudi Arabia

Can several instruments for one debt all be collected in full?

Reconcile their purpose and every payment. Security or replacement instruments must not be treated as separate economic debts without examining the underlying obligation and cancellation or replacement evidence.

Should I keep a replaced note?

Preserve the replacement agreement and cancellation evidence so the relationship between instruments is clear.

Does a signature dispute need the original record?

The original or authoritative electronic record can be important. Identify how authenticity can be examined rather than relying on an unclear image.
